Terms and Conditions
Article 1 – Definitions
In these general terms and conditions, the following definitions apply:
Cooling-off Period: The 100-day period within which the consumer may exercise their right of withdrawal; Consumer: The natural person who does not act in the exercise of a profession or business and enters into a distance contract with the entrepreneur; Continuing Transaction: A distance contract relating to a series of products or services, where the delivery obligation is spread over time; Right of Withdrawal: The consumer's right to cancel the distance contract within the cooling-off period; Entrepreneur: Crumbs, the natural or legal person who offers products remotely to consumers; Distance Contract: An agreement concluded between Crumbs and the consumer via remote communication techniques; CESOP: The Central Electronic System for Payment Information, introduced by the EU to monitor payment service providers.

Article 3 – Applicability
These general terms and conditions apply to every offer made by Crumbs and to every distance contract concluded. Before the contract is concluded, these terms will be made available to the consumer electronically or in another manner.
Article 4 – The Offer
All offers from Crumbs are non-binding. Crumbs reserves the right to modify or withdraw offers. The offer clearly states the total costs, including shipping costs, import duties, and any additional charges from postal or courier services.
Article 5 – The Contract
The contract is concluded as soon as the consumer accepts Crumbs' offer and meets the stated conditions. Acceptance is confirmed by Crumbs via email.
Article 6 – Right of Withdrawal
The consumer has the right to cancel the contract within 100 days of receiving the product, without giving any reason. The cost of return shipping is the responsibility of the consumer.
Article 7 – Costs Upon Withdrawal
Crumbs will refund the amounts paid by the consumer within 30 days of receiving the notice of withdrawal, provided the returned product has been received in its original condition and packaging.
Article 8 – Customs, Import Duties and VAT Obligations
8.1 All products are shipped under the delivery term Delivered Duty Unpaid (DDU). This means the consumer is fully responsible for all import costs and obligations upon entry into the destination country.
8.2 These obligations include, but are not limited to:
- payment of import duties, VAT, or other taxes;
- clearance costs such as brokerage and administrative fees from couriers or customs authorities;
- compliance with local legislation and product regulations in the country of delivery.
8.3 Crumbs does not act as the formal importer of the ordered products. Ownership and responsibility transfer to the consumer upon shipment. Crumbs is not liable for delays, seizures, or costs resulting from the consumer's non-compliance.
8.4 Crumbs provides the required shipping documentation (such as invoice, product description, and value), but does not guarantee that these meet the specific requirements of the destination country.
8.5 The consumer indemnifies Crumbs against all financial consequences, claims, or penalties resulting from non-compliance with import regulations.
8.6 It is strongly recommended that consumers contact their local customs authorities prior to placing an order to avoid any surprises at the border.
Article 9 – CESOP Compliance
From 2024, payment service providers will record transaction data in the European CESOP system. Crumbs complies with this regulation, which may affect the monitoring and reporting of payments.
Article 10 – Conformity and Warranty
Crumbs guarantees that products conform to the agreement and meet legal requirements. Complaints about defects must be reported in writing no later than 14 days after receipt. Returns must be made in original condition and packaging.
Article 11 – Delivery
Orders are delivered within 30 days, unless otherwise agreed. In the event of a delay, the consumer will be informed no later than 14 days after placing the order. The consumer is responsible for handling import procedures. Crumbs operates in accordance with international shipping standards but is not liable for customs delays. Non-compliance by the consumer with import obligations does not entitle them to cancellation or refund.
Article 12 – Complaints
Complaints must be submitted in writing within 7 days of discovery. Crumbs will respond within 14 days. If a complaint requires more time, an indication of the handling timeline will be provided.
Article 13 – Disputes
These terms are governed by Dutch law. Disputes are preferably resolved through mutual consultation. If necessary, disputes will be submitted to the competent court in the Netherlands.
